Construction Firm Held Guilty Of Bid Rigging: $6.5m Fine Imposed

One such case has recently been reported in Michigan state where a private construction firm was held guilty of a bid-rigging scam that gathered all the nominees and other authorities on one board.

On January 30, 2024, Asphalt Specialists LLC, based in Pontiac, was obliged to pay a huge $6.5 million fine after admitting guilt in a bid-rigging scam. Remind that this is one of the gigantic legal defeats for the construction industry.

Asphalt Specialists LLC, is a private U.S.-based firm that has been in the limelight for two major conspiracies lately.

  • The first conspiracy featured cooperation with Al’s Asphalt Paving Company Inc. (Al’s Asphalt), and it spanned from March 2013 to November 2018. 
  • The company collaborated with F. Allied Construction Company Inc. (Allied) during the second conspiracy, which ran from July 2017 to May 2021.

The U.S. Department of Justice (DoJ) stated that these conspiracies were preplanned by the participating companies trading bid pricing to ensure that one would get the contract while the others purposely submitted non-competitive bids. This dishonest technique created the appearance of competition while deceiving buyers and compromising the fairness of the bidding procedure.

What investigation proceeded by Federal Authorities

Asphalt Specialists LLC is the latest company to be impacted by a federal anti-monopoly inquiry into bid-rigging and other anti-competitive activities in the asphalt paving services sector.

Al’s Asphalt entered a guilty plea on July 31, 2024, and as a result, was already fined $795,661.81. Allied, which has entered a guilty plea as well, is presently awaiting punishment. Six other people have also been charged in relation to the inquiry.

“Anyone who chooses corporate greed over transparent and equitable competition for transportation projects should be severely discouraged by the punishment handed down today. We remain steadfast in our resolution to collaborate with law enforcement and the Justice Department’s Antitrust Division in our efforts to expose and prosecute corrupt behaviour and hold firms accountable for their deliberate wrongdoing.”

This case serves as a stark warning to other businesses thinking about engaging in similar anti-competitive behaviour and highlights the necessity for fairness and transparency in the bidding process.

As the construction industry does not move alone, it co-exists with the heavy equipment sector. Fraudulent cases like this will not only impact one sector but the other one will be affected ultimately under the influence.
